These Terms of Service (the “Terms”) form a binding agreement between you and Omnigame (“we”, “us”, “our”), the developer of Cozypop Trails (the “App”). By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. You must be at least 13 years old, or the minimum age of digital consent in your country, to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or guardian.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial entertainment, in accordance with these Terms and the App Store Terms of Service. We reserve all rights not expressly granted.

The App may include in-game elements such as level progress, “hearts”/lives, streaks, and similar features. These elements have no monetary value, are not your property, cannot be redeemed for cash or anything of value, and are not transferable. We may modify, regenerate, reset, suspend, or remove any such in-game elements, levels, or features at any time, for example to balance difficulty or maintain the App. Progress and settings are stored locally on your device and may be lost if you delete the App or change devices.
The App currently contains no in-app purchases, subscriptions, or third-party advertising. If we introduce paid features in the future, they will be processed by Apple through the App Store, any recurring charges and their terms will be clearly disclosed before purchase, and additional terms (including Apple’s) will apply. We will update these Terms accordingly.
The App, including its levels, artwork, audio, text, design, and code, is owned by Omnigame or its licensors and is protected by intellectual-property laws. Except for the limited license in Section 2, these Terms do not grant you any rights in the App or our trademarks, logos, or brand features.
Your use of the App is also governed by our Privacy Policy, which explains what limited, anonymous data we collect and how you can opt out of analytics in the App’s Settings.
The App uses Google Firebase (Analytics and Crashlytics) and is distributed through the Apple App Store. Your use of those services is subject to their own terms and policies. We are not responsible for third-party services.
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
To the maximum extent permitted by law, in no event will Omnigame be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, progress, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid us for the App (if any) or USD 10. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Omnigame from any claims, damages, liabilities, and expenses arising out of your misuse of the App or violation of these Terms or applicable law.
These Terms apply until terminated. Your license ends automatically if you fail to comply with them. You may end it at any time by deleting the App. We may suspend or discontinue the App, in whole or in part, at any time. Sections that by their nature should survive termination (including Sections 6, 9, 10, 11, 14, and 16) will survive.
We may update, change, or discontinue the App or any feature at any time. We may also revise these Terms; when we do, we will update the “Last updated” date above and post the new version at this URL. Your continued use of the App after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in California, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
